What are Lasting Powers of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (attorneys) to make decisions on your behalf if you lose mental capacity or become unable to manage your own affairs.

There are two main types of LPA:

Property and Financial Affairs LPA – covers managing your money, property, and financial matters.

Health and Welfare LPA – covers medical treatment, care decisions, and day-to-day wellbeing.

Having an LPA ensures that someone you trust will step in to act on your behalf which avoids court delays, stress, and uncertainty for you and your loved ones.

Why setting up a Lasting Power of Attorney matters

Contrary to popular belief, your spouse or next of kin is not automatically granted the power to make financial or medical decision on your behalf. Without an official LPA, they will have to apply to the court for permission.

Setting up an LPA provides:

  • The power to decide who can make decisions for you and under what circumstances
  • Legal authority for your attorneys so your affairs are handled properly and in your best interests
  • Avoidance of delays and costs associated with Court of Protection applications
  • Protection of finances and assets as trusted individuals manage bank accounts, bills, and investments if you can’t
  • Continuity of care and wellbeing, with important medical and care decisions being made by trusted people
  • Reduced stress, and clarity over arrangements and wishes during difficult times
